General Terms and Conditions (GTC) of Pfyn-Finges Nature Park
I. Scope of application
1.1 These General Terms and Conditions apply to all contractual relationships between the Pfyn-Finges living and adventure area, hereinafter referred to as “NPF” (Naturpark Pfyn-Finges) and its customers. They apply to services such as excursions, adult courses and all other bookable offers provided by NPF.
1.2 The General Terms and Conditions must be accepted by the customer at the time of booking / ordering. They can only be accepted or rejected in their entirety. The details are listed under Section 2.
1.3 A distinction is made between offers provided by NPF and those made available by NPF as a platform for third parties. If NPF is the event organiser and therefore the contracting party, these General Terms and Conditions apply. If NPF acts solely as a platform, the third-party provider’s General Terms and Conditions apply. The details are set out in sections 7-9. The relevant third-party provider is clearly indicated for each offer.
II. Nature Park as the event organiser
Where NPF acts as the event organiser, the contract is concluded between the customer and NPF as follows.
2. Conclusion of contract and services
2.1 The offers on the NPF website or other means of communication constitute a non-binding offer. A binding contract is concluded when NPF confirms the customer’s booking / order.
2.2 By making a booking, the customer unconditionally accepts these General Terms and Conditions, the Privacy Policy (see Section 11) and the prices specified at the time of booking.
2.3 Where services are booked on behalf of other participants, the person making the booking is the contracting party and is responsible for payment and fulfilment of the obligations of all participants.
2.4 The scope of the services covered by the contract is set out in the booking confirmation.
3. Payment terms and prices
3.1 All prices are quoted in Swiss francs (CHF) and include statutory VAT. The prices given in the booking confirmation are binding.
3.2. If payment is not received by the due date, NPF as the contracting party may withhold all services, terminate the contract and charge any applicable cancellation fees in accordance with Section 4.
4. Cancellation and amendments to the contract by the customer
4.1. Cancellations and changes to services already confirmed must be made in writing by the customer.
4.2. The number of participants stated in the confirmation is binding. If fewer participants attend than confirmed, the full price remains payable.
4.3. If the customer cancels the booking before the services commence, the following cancellation fees apply:
a) For group bookings:
• Up to 7 days before the services commence: 0% of the total price
• 6 to 0 days before the services commence: 100% of the total price
b) For NPF offers listed in the events calendar:
• Up to 4 days before the services commence: 0% of the total price
• 3 to 0 days before the services commence: 100% of the total price
4.4. Failure to attend (no-show) is treated as a cancellation. The applicable charges still apply or are invoiced in accordance with Section 4.3.
4.5. If a participant is unable to attend, a substitute may take their place. NPF must be informed in advance.
4.6. Customers are responsible for their own travel arrangements. No refunds are given for late arrivals.
5. Cancellation and amendments to the contract by NPF
5.1. NPF undertakes to provide the services covered by the contract in accordance with the agreed terms.
5.2. If the provision of a service is disrupted or prevented by force majeure (e.g. environmental disasters, natural hazards, epidemics, etc.), safety concerns, official measures of any kind, strikes, etc., NPF is entitled to cancel the booking.
5.3. If NPF has to cancel an event after it has started, no refund will be given.
5.4. If NPF has to cancel the service after confirming the booking, any payments already made by the customer will be refunded. Any outstanding amounts owed by the customer to NPF will be cancelled.
5.5. Some events are based on a minimum number of attendees. If this minimum number is not reached, NPF will cancel the booking after the registration deadline. The customer will be notified, and any payment already made will be refunded.
5.6. If an event has to be terminated due to the customer’s misconduct, no refund of any kind will be due.
6. Liability
6.1. As the event organiser, NPF is liable only for intentional acts and gross negligence. Liability for minor negligence, and for third parties assisting in the provision of services, is excluded. NPF does not accept liability for incidents caused by the customer’s own actions or by third parties. Liability for loss of profit and any further direct or indirect consequential losses is excluded. For school excursions, disciplinary supervision is the responsibility of the teacher in charge.
6.2. Customers are responsible for their own insurance coverage, in particular accidents and health insurance, as well as coverage for damage to or loss of personal belongings and luggage. NPF disclaims all liability.
6.3. NPF accepts no liability for items brought by the customer or rented from or provided by NPF.
III. Nature Park as a platform
7. Where NPF advertises offers from third-party providers, the contract is concluded between the customer and the relevant event organiser. The services provided by third parties are subject to the terms and conditions of the respective provider.
8. As the customer’s contractual partner, the third party is solely responsible for fulfilling the contract. NPF assumes no liability for the proper performance of the contract. Any complaints must be addressed exclusively to the third party.
9. In the event of cancellation, the third party’s General Terms and Conditions apply.
10. NPF accepts no liability whatsoever for any damage suffered by the customer in connection with services provided by third parties. Any claims for damages must be directed to the third party.
